These Terms of Use govern access to econtractor.com.ua and use of the eContractor CRM ERP platform. By using the website or platform, the user confirms that they have read and accepted these terms.
1. Purpose of eContractor
eContractor is a CRM ERP platform for installation businesses, helping manage leads, customers, tasks, jobs, crews, warehouse, products, services, documents, payments, reports and integrations.
The website has informational, presentation and communication purposes. Paid SaaS access is governed by the Public Offer or a separate agreement, invoice, commercial proposal or written arrangement.
2. Account and access
CRM access is provided to users or companies according to the selected package, account settings, roles and permissions.
The user is responsible for keeping login credentials, passwords, Google account access, session tokens and other access tools confidential.
Accounts, passwords, sessions or credentials may not be transferred to third parties without authorization from the account administrator and eContractor.
eContractor may temporarily restrict or block access if unauthorized use, breach of these terms, security bypass attempts or harmful activity is suspected.
3. User-entered data
The user and customer are responsible for the legality, accuracy, completeness and relevance of data entered into the system.
It is prohibited to enter data without a legal basis, or materials that violate third-party rights, contain unlawful content or may be used for fraud.
Users may not disclose customer, counterparty, employee, contractor or other data to third parties unless they have a lawful basis, authority or consent.
4. Confidentiality and business information
Account data, customer base, financial information, proposals, contracts, documents, warehouse balances, prices, margins, reports and internal processes are confidential information of the relevant customer.
Users must use such information only within their work authority and must not disclose it to third parties.
The account administrator is responsible for configuring roles, access rights and user control within the company account.
5. Prohibited actions
It is prohibited to attempt unauthorized access to accounts, servers, APIs, databases or system areas not intended for the user.
Users may not interfere with service operation, overload the service, bypass limits, copy or reverse engineer software code, use the system for spam, fraud, unlawful data collection or rights violations.
Users may not resell access or use eContractor as part of another service without separate written consent.
6. Payment, packages and refunds
Paid packages, prices, access periods, service scope and limits are defined on the website, in an invoice, commercial proposal or separate agreement.
Refunds for already paid packages are not provided unless expressly agreed in writing or required by mandatory law.
After payment, eContractor provides access to the paid package until the end of the paid period, subject to compliance with these terms and absence of technical or legal grounds for restriction.
If the customer does not renew after the paid period, access to paid functions may be restricted, suspended or moved to the mode provided by the current service rules.
7. Data, backups and liability
eContractor makes reasonable efforts to maintain service stability, data preservation and protection from unauthorized access, but does not guarantee uninterrupted operation or absence of technical failures.
The customer is responsible for critical business decisions, verification of financial calculations, control of documents, payments, warehouse operations and any internal backups required by its policies or law.
Unless a separate written agreement states otherwise, eContractor's liability is limited to the amount actually paid by the customer for the relevant package during the period in which the claim arose.
8. Integrations and third-party services
eContractor may integrate with Google, Telegram, APIs, email services, counterparty verification tools, file storage, payment or other third-party tools.
Third-party services are governed by their own terms, privacy policies and technical limitations. eContractor is not responsible for their outages, API changes, blocking, pricing or restrictions.
The customer is responsible for ensuring that integrations, API data transfer and webhook settings comply with its internal rules, customer agreements and legal requirements.
9. Intellectual property
Software code, design, interfaces, structure, texts, visuals, logos and other eContractor elements belong to eContractor or are used lawfully.
The user receives the right to use the service within paid or granted access, but does not obtain ownership of software, trademarks, design or other intellectual property.
Copying, modifying, decompiling, distributing or creating derivative products based on eContractor without written permission is prohibited.
10. Changes and termination
eContractor may update these Terms of Use, service functionality, prices, limits and usage rules.
The current version is published at econtractor.com.ua/ua/terms or the corresponding localized URL. Continued use after an update means acceptance of the updated terms.
In case of material breach, eContractor may restrict or terminate access while retaining the right to payment for access already provided or paid.
